David Walliams is suing Freemantle Media, the production company behind ITV's Britain's Got Talent.
The action is listed as dealing with data protection.
Walliams was a judge on the hit show from 2012 to 2022, but last year admitted making "disrespectful comments" about two contestants during filming in 2020. He apologised and said that the remarks "were never intended to be shared".
The comedian, who is also a best-selling children's author, said at the time: "I would like to apologise to the people I made disrespectful comments about during breaks in filming for Britain's Got Talent in 2020.
"These were private conversations and - like most conversations with friends - were never intended to be shared. Nevertheless, I am sorry."
Walliams did not return as a judge when the show returned in 2023.
